Legislative Priorities
MNHBP seeks sensible, technically sound regulation that keeps consumers safe, enables efficient operations, and sustains Minnesota jobs. We are prepared to supply plant-level data and solutions to support these changes.
1. Fix Testing and Laboratory Restrictions
Issue: Testing limited to Minnesota labs and inconsistent COA rules.
Request:
- Permit any ISO-accredited lab that meets quality and reporting standards.
- Standardize Certificate of Analysis requirements across products.
- Remove unnecessary COA customization that adds cost without improving safety.
2. Modernize Labeling with QR Codes
Issue: “Affixed” interpretations force crowded labels and limit traceability.
Request:
- Allow required information to be provided via QR code on the package.
- Remove mandatory physical listing of cultivator and emulsion manufacturer.
- Maintain chain-of-custody with digital records accessible through QR code.
3. Resolve the Non-Concentrated Emulsion Rule
Issue: Interim emulsions capped at 0.3% THC disrupt normal manufacturing and raise costs.
Request:
- Allow higher THC concentrations during intermediate stages when finished goods meet low-potency limits.
- Pair with appropriate security, safety, and tracking measures.
4. Clarify Transportation and B2B Shipping
Issue: Ambiguity around who may transport products limits standard freight use.
Request:
- Confirm licensed wholesalers and common carriers (UPS, LTL, similar) may transport between licensed entities.
- Align hemp beverage logistics with established food and beverage practices.
5. Preserve and Clarify Direct-to-Consumer Shipping
Issue: DTC shipping now constrained by interpretation, not statute.
Request:
- Restore DTC shipping with robust age verification and delivery safeguards.
- Ensure Minnesota brands are not disadvantaged versus out-of-state producers.
6. Structure Engagement with OCM
Issue: Rapid change demands continuous technical dialogue.
Request:
- Establish regular OCM–industry working sessions for the 2026 legislative and rulemaking process.
- Use sessions to vet technical impacts and prevent unintended consequences.
